From trade name to trade licence

A trade name is not a trademark

Here is a distinction many businesses miss, and it is an expensive one: reserving a trade name in the commercial register is not registering a trademark. The first allocates you a name in the companies register; the second gives you an exclusive right to use that name in the market as a brand.

You can hold a commercial registration in one name while somebody else registers the same name as a trademark — and find yourself barred from using your own name on your own products. Because we do both, we check both from the outset: is the name available to reserve, and is it available to register as a mark?

Common questions

Does reserving a trade name protect my brand?

No. Reserving a name in the commercial register is a different procedure from registering a trademark. To protect the name as a brand in the market it has to be registered as a trademark with the Ministry of Commerce and Industry.

Yes — changes of activity, partners, managers and address, renewal of the registration and licence, and the establishment file, with every date docketed and followed up before it falls due.
